Web Hosting Agreement and Terms of Service.

These terms and conditions govern the use of the Purple Media website (https://www.purplemedia.com) and the purchase of any products or services from it. Make sure you read and agree to these terms before signing up. If you have any questions about our Services, Prices, Terms & Conditions, or Policies, please contact us. Purple Media reserves the right to change the use of policies and terms at any time. We serve various clients and prioritize their security.

Change in Packages and Pricing

Purple Media reserves the right to change prices, services, and offered packages at any time without prior notice. New prices will apply to new deals. Orders placed before the announcement of new prices will be treated as per the previous rates.

Work will commence only after payment is received in our account. Providing all necessary information to verify payment is your responsibility; delays may occur if not provided. If there is no communication from the customer for over 30 days, the project will be put on HOLD. Projects with no communication for over 90 days will be treated as closed.

Late/Non-Payment

  • An administrative fee of 20% of the project cost will be charged to restart work that has been halted due to late or non-payment.
  • Technical support will be revoked after 7 days of the due date for delayed payments.
  • Website and services will be suspended after 14 days of non-payment.
  • Website and data will be deleted from all our systems after 30 days of non-payment.
  • In case of credit card chargeback and transaction reversal, all your data, including your website and emails, will be immediately deleted.
  • Customers must update accurate contact details; we will not be responsible for any action taken due to failure to receive or respond to our notices.

Spam Policy

We enforce a zero-tolerance policy towards Unsolicited Commercial Email (UCE) or SPAM on our network. Clients are prohibited from using our network to manage UCE or Spam. Violations will result in strict penalties, including immediate termination of services. We investigate any such violations promptly. Confirmed violations may result in account termination and possible legal actions. Penalties include administrative fees of Rs. 5000 for the first violation and Rs. 7500 for subsequent violations.

Proscribed Use of Services and Products

Clients may only use Services and Products in a manner consistent with the company’s purpose. If unsure, contact the company. Prohibited uses include:

  • Illegal Activities: Broadcasting, storing, or circulating data/material that breaches any law or guideline is prohibited.
  • Injury or Peril to Others: Use of services to harm or threaten physical injury or property destruction is prohibited.
  • Copyright or Trademark Violation: Broadcasting material that violates any intellectual property rights is prohibited.
  • System and Network Abuse: Any activity that breaches system or network security is forbidden.

Proscribed Scripts and Programs

Scripts must not exceed a few seconds of processor time and should not use excessive system resources. Accounts using scripts that overconsume resources will be suspended. Prohibited scripts include those that interact with hardware or server configuration files, or are detrimental in nature.

Loss of Backup and Data

Usage of our services is at your own risk. We are not responsible for any data loss. Clients are responsible for maintaining proper backups. We take weekly backups for server restoration purposes.

Mailing List Hosting

We do not host mailing lists and will shut down any found on our servers without notice. We prohibit adult content and any website encouraging illicit activity.

Ownership and Intellectual Property

Clients do not own the web server, CMS, or database software. Ownership extends to HTML/CSS/JavaScript, visual design, and text content after project completion and final payment. Clients own their website data if they authored it.

Web Hosting and Domain Details

We maintain the security of the web server and will not share web hosting credentials. Domain credentials purchased by us for clients’ websites will be shared only under specific conditions and written agreements.

Support

Support is provided via email at support@purplemedia.com. We offer limited assistance for third-party software and initial custom configurations.

Third-Party Software Installation

Clients installing third-party software are solely responsible for security breaches resulting from such software. We reserve the right to terminate the website without notice in case of detected hacking activities.

Responsibilities and Limitations

We are not responsible for any damages, including data loss, resulting from server unavailability or downtime. Our liability is limited to immediate termination of services in such scenarios.

Stipulation and Disclaimer

We do not guarantee profits, data accuracy, or uninterrupted service. We are not responsible for errors, omissions, or any technical issues arising from the use of our services. Links to non-Purple Media websites are not controlled by us, and we do not endorse them.

Trademark

Purple Media logos and trademarks are owned by Purple Media and must not be used without written permission.

Privacy Policy

All information provided is used in accordance with respective laws and will not be shared without written consent. Temporary cookies are used to improve the browsing experience.

Payment and Refund

All payments are accepted through standard modes. There is no provision for partial or full refunds once an order is placed. The paid amount is non-refundable under any circumstances.
